The terms that govern your use of Everhelm Studios' websites, client portal, and services.

Acceptance of Terms

These Terms of Service ("Terms") form a binding agreement between you and Everhelm Studios ("Everhelm," "we," "us," or "our") governing your access to and use of our websites, client portal, and related services (the "Services"). By accessing or using the Services, you agree to these Terms. If you are using the Services on behalf of a business, you represent that you are authorized to bind that business.

Description of Services

Everhelm provides custom website development, managed hosting, domain management, business automation, and platform integrations through a client portal. Features and availability may change over time as we improve and expand the Services.

Accounts & Eligibility

  • You must be at least 18 years old and able to form a binding contract.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activity that occurs under your account.
  • You agree to provide accurate, current, and complete information and to keep it updated.
  • Notify us immediately of any unauthorized use of your account.

Billing & Subscriptions

Paid Services are billed in advance on a recurring basis through our payment processor. By subscribing, you authorize us to charge your payment method for applicable fees.

  • Fees are non-refundable except where required by law or expressly stated.
  • Subscriptions renew automatically until cancelled.
  • You may cancel at any time; access continues through the end of the current billing period.
  • We may change pricing with reasonable advance notice.
  • Late or failed payments may result in suspension of the Services.

Acceptable Use

You agree not to use the Services to:

  • Violate any law, regulation, or third-party rights.
  • Upload or distribute malware, or attempt to disrupt or compromise the Services.
  • Send spam or unsolicited communications, or engage in fraudulent activity.
  • Publish unlawful, infringing, defamatory, or harmful content.
  • Reverse engineer, scrape, or gain unauthorized access to any part of the Services.
  • Misuse connected platform permissions in violation of that platform's terms.

Connected Platforms

When you connect a third-party platform (such as Facebook, Instagram, or Google), you authorize Everhelm to access and act on data from that platform within the permissions you grant. You remain responsible for complying with each platform's terms, and you may revoke access at any time from the Connections page. Everhelm's handling of connected data is described in our Privacy Policy.

Your Content

You retain ownership of the content and data you provide or manage through the Services ("Your Content"). You grant Everhelm a limited license to host, process, and display Your Content solely to operate and provide the Services. You are responsible for ensuring you have the rights to Your Content.

Intellectual Property

The Services, including software, design, branding, and the Everhelm Forge platform, are owned by Everhelm Studios and protected by intellectual property laws. Except for the rights expressly granted to you, no rights are transferred. You may not copy, modify, or create derivative works of the Services without our written permission.

Third-Party Services

The Services integrate with third-party platforms and tools. We are not responsible for the availability, accuracy, or practices of third-party services, and your use of them is governed by their respective terms and policies.

Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

Limitation of Liability

To the maximum extent permitted by law, Everhelm Studios will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid to us in the twelve months preceding the claim.

Termination

You may stop using the Services and close your account at any time. We may suspend or terminate your access if you violate these Terms, fail to pay applicable fees, or if required by law. Upon termination, your right to use the Services ends, and we will handle your data as described in our Privacy Policy and Data Deletion page.

Changes to Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
